Meanwhile, in state court Trump's attorneys were arguing on Friday for the disqualification of more than 221,000 ballots cast in Milwaukee and Dane counties. He is not challenging any ballots cast in counties he won. Trump wants to disqualify absentee ballots cast early and in-person, saying there wasn’t a proper written request made for the ballots; absentee ballots cast by people who claimed “indefinitely confined” status; absentee ballots collected by poll workers at Madison parks; and absentee ballots where clerks filled in missing information on ballot envelopes. If Trump loses in state court, he can seek an appeal before the conservative-controlled Wisconsin Supreme Court. A majority of justices have also openly questioned whether disqualifying the ballots as Trump is seeking would be appropriate.

U.S. District Judge Brett Ludwig, a Trump appointee, marveled at the president's request at Thursday's hearing. "This court should reject it.”Attorneys for Evers and the Wisconsin Elections Commission asked Ludwig to dismiss the case, arguing it belonged in state court, not federal. Similar lawsuits, all filed by Trump’s former campaign attorney Sidney Powell, have been dismissed in Arizona, Georgia and Michigan. Powell appealed the Wisconsin ruling on Thursday to the 7th U.S. A hearing in Trump's state lawsuit, originally scheduled for Thursday, was pushed until Friday morning because the arguments in federal court had not concluded.

Trump is not challenging any ballots in the state's other 70 counties, the majority of which Trump won. “President Trump’s (lawsuit) seeks nothing less than to overturn the will of nearly 3.3 million Wisconsin voters,” Evers' attorneys said. Trump’s lawsuit repeats many claims he made during a recount of votes in Milwaukee and Dane counties. None of the ballots Trump challenged during the recount were discounted by elections officials in Dane and Milwaukee counties.

Trump asked the Wisconsin Supreme Court to take the case directly, rather than have it start in a lower court, and order Evers to withdraw the certification. Separately, two Wisconsin Republicans filed a new federal lawsuit Tuesday that mirrors some of Trump's claims and asks a judge to declare him the winner in Wisconsin. Trump's Wisconsin lawsuit seeks to discard 170,140 absentee ballots where there was not a written application on file and all absentee ballots cast in person during the two weeks before Election Day. Trump wants to toss 5,517 ballots where election clerks filled in missing address information on the certification envelope where the ballot is inserted. Also Tuesday, Republicans on the Wisconsin Elections Commission asked the Democratic chairwoman to resign after she finalized election results on Monday.

With no precedent for overturning a result as large as Biden's, Trump was widely expected to head to court once the recount was finished. Election officials in the two counties counted those ballots during the recount, but marked them as exhibits at the request of the Trump campaign. Trump legal challenges have failed in Arizona, Georgia, Michigan, Nevada and Pennsylvania.

Milwaukee County officials said they plan to finish the recount by Wednesday. The commissioners deadlocked on making changes to the manual that Democrats and elections commission staff said would bring the guidance into line with current state law. Republicans balked, saying the guidelines should not be changed after Trump filed for the recount. Milwaukee County is the state’s largest, home to the city of Milwaukee, and Black people make up about 27% of the population, more than any other county.

“Regrettably, the integrity of the election results cannot be trusted without a recount in these two counties and uniform enforcement of Wisconsin absentee ballot requirements. “It’s not surprising at all that Donald Trump, the Trump campaign, wants to have one last mass gathering that will put people’s health in peril,” Barrett said. The Wisconsin Elections Commission late Wednesday night voted to approve issuing an order on Thursday to commence the recount. The Wisconsin Supreme Court ordered McDonell to stop issuing guidance that is different from official language approved by the Wisconsin Elections Commission. The Trump campaign alleged that “the damage was already done” before McDonell was ordered to remove the language.

There were several reasons why some ballots were counted or not during the 2016 recount, said Scott McDonnel, the Dane County clerk, on Wednesday.

MADISON, Wis. – Hackers have stolen $2.3 million from the Wisconsin Republican Party's account that was being used to help reelect President Donald Trump in the key battleground state, the party's chairman told The Associated Press on Thursday. The party noticed the suspicious activity on Oct. 22 and contacted the FBI on Friday, said Republican Party Chairman Andrew Hitt. “We have been in contact with the state party and are assisting them through this process," said Republican National Committee spokesman Michael Ahrens. “I can’t see any upside for them in this matter.”Hitt stressed that the money stolen was for services already rendered. The state Democratic Party raised nearly $59 million over the past two years compared with just $23.7 million for Republicans.

9 Wisconsin canceled its game at Nebraska and paused team activities for at least a week after a dozen people in the program — including coach Paul Chryst — tested positive for COVID-19. Alvarez said the team had only one positive test two days before Friday's season-opening 45-7 victory over Illinois and 12 positive tests afterward. Alvarez said Wisconsin had reached the “orange/red” levels in the Big Ten protocols based on its rate of positive tests. The announcement followed reports that quarterback Graham Mertz had tested positive twice – which would require him to sit out at least 21 days under Big Ten protocols – and that backup quarterback Chase Wolf had tested positive at least once. “We’ll see where we are as far as testing, and we’ll make that decision as we move closer to the game,” Alvarez said.

If the ruling stands, absentee ballots will have to be delivered to Wisconsin election clerks by 8 p.m. on Election Day if they are to be counted. Under state law, absentee ballots are due in local clerks’ offices by 8 p.m. on election night. Wisconsin, like much of the rest of the country, is already seeing massive absentee voting for November and the state expects as many as 2 million people to vote absentee. After the Wisconsin Supreme Court affirmed that standing, the same three-judge panel delivered Thursday's ruling. Conley came up with a “limited, reasonable set of modifications” to election rules to preserve “the precious right of each Wisconsin citizen to vote,” she wrote.
